Guest liability waiver
Hosts can require this waiver at booking (toggle it on in the listing editor, step 6). Guests must accept it before a booking on that listing is confirmed, and the acceptance is timestamped on the booking record. It releases ordinary recreation risks but never releases a host's own gross negligence or willful misconduct. Release of Liability & Assumption of Risk
In consideration of being granted access to the property described in this booking (the "Property"), I agree, for myself and any minors I supervise:
1. ASSUMPTION OF RISK. I understand that outdoor recreation — including hunting, fishing, foraging, hiking, swimming, camping, riding (ATV, horse, or bicycle), winter sports, paddling, and similar activities — is inherently dangerous. Risks include, without limitation: uneven or unstable terrain; weather; falling trees or limbs; open water and ice; wild animals and livestock; insects; poisonous or misidentified plants and fungi; firearms and archery equipment; vehicles and machinery; tree stands and structures; and the acts of other people. I voluntarily accept ALL such risks, known and unknown.
2. RELEASE. To the fullest extent permitted by law, I release, waive, and discharge the Property owner(s), their family, employees, and agents (the "Owner") from any and all claims, demands, and causes of action arising out of my presence or activities on the Property, including claims based on the Owner's ORDINARY NEGLIGENCE. THIS RELEASE DOES NOT APPLY to harm caused by the Owner's GROSS NEGLIGENCE, RECKLESSNESS, or WILLFUL OR MALICIOUS MISCONDUCT, or to any liability that cannot be waived under the law of the state where the Property is located.
3. MY RESPONSIBILITIES. I will follow all Property rules, harvest limits, and zone boundaries; hold all licenses required for my activities; never consume any foraged plant or mushroom I have not identified with certainty; use safety equipment appropriate to my activities; and supervise any minors with me at all times.
4. MEDICAL. I am physically able to participate in my planned activities. I authorize emergency medical treatment if I am unable to consent, at my own expense.
5. INDEMNITY. I will indemnify the Owner against claims brought by my guests or minors arising from our presence on the Property, except to the extent caused by the Owner's gross negligence or willful misconduct.
6. SCOPE. This release covers every visit made under this booking and binds my heirs and representatives. If any part is unenforceable, the remainder stands. WildPass is a marketplace platform, is not a party to this agreement, and provides it as a template without warranty.
